It should be possible to get a Lion Upgrade (Snow Leopard Required) from any Apple store.
As of Mountain Lion things might change again, but I wouldn't be surprised (after a delay) to see Mountain Lion on USB too
You should be able to clean install Lion without Snow Leopard being present, I have done it several times.
Mountain Lion will clean install and go on top of Lion if needed. It is NOT a good idea to migrate any applications or utilities from Lion to ML, get fresh versions from the creators.
