Hmmm. Now I wish this was as easy as that.  This is an exceptionally easy one to take to court but in a way still a little strange but I can see the legal standpoint.

This may be a real can of worms for photographers. Almost anything man made in the last 75 years probaly could be clamed to be copyrighted and that your comercial use of it was not "fair use".
